1. Acceptance of these terms
By visiting or using this website, you agree to be bound by these Terms of Use. If you do not agree, please do not use this site. These terms apply to all visitors, customers, and anyone who browses, purchases from, or contacts WCRB Design through this website.
2. Intellectual property
All artwork, images, photographs, text, and other content on this website are the exclusive property of William Rivera-Bloodworth and are protected by U.S. and international copyright law. No content may be reproduced, copied, distributed, downloaded, or used in any form without prior written permission.
Purchasing a physical work or print does not transfer copyright or reproduction rights. You may not reproduce, scan, or digitally recreate any purchased work without a separate written licensing agreement.
3. Reproduction and licensing
All reproduction rights to works by William Rivera-Bloodworth are reserved. WCRB Design does not currently offer licensing of artwork for commercial, editorial, print-on-demand, or any other third-party use.
If you are interested in discussing a potential licensing arrangement in the future, you may direct inquiries to william@wcrb.design. Inquiries do not create any obligation or implied license on the part of WCRB Design.
4. Moral rights and resale
William Rivera-Bloodworth asserts his moral rights as the creator of all original works, including the right of attribution and the right of integrity, under the Visual Artists Rights Act of 1990 (VARA), 17 U.S.C. § 106A. These rights apply to original works of visual art and include the right to claim authorship, to prevent the use of his name on works he did not create, and to prevent intentional distortion, mutilation, or destruction of works that would harm his honor or reputation.
The sale of an original work does not waive these rights unless a separate written waiver is signed. Buyers are encouraged to preserve the integrity of purchased works and to maintain any certificate of authenticity or documentation that accompanies them.
WCRB Design does not participate in proceeds from secondary market resales. However, William Rivera-Bloodworth requests that he be notified of any resale of original works as a matter of professional courtesy, and that attribution be maintained in any future exhibition, publication, or display.
5. Purchases — Original works and prints
All sales are final unless the item arrives damaged or materially different from its listing. If you receive a damaged item, please contact william@wcrb.design within 5 days of delivery with photographs, and a resolution will be arranged.
Colors may appear differently on screen than in person due to monitor calibration and photographic lighting. This does not constitute grounds for a return.
Shipping timelines are estimates and not guaranteed. WCRB Design is not responsible for delays caused by carriers or customs.
6. Sales tax
WCRB Design collects New York State sales tax on applicable purchases in accordance with New York tax law. The applicable tax rate will be calculated and displayed at checkout based on the delivery address. Buyers are responsible for any additional use tax obligations in their own jurisdiction.
7. Commissions
Commission inquiries submitted through this website are not binding contracts. A commission agreement is only established when both parties have signed a written commission contract and any required deposit has been received.
Commission timelines, revision terms, payment schedules, and cancellation policies are defined in that separate agreement. Copyright in commissioned works remains with William Rivera-Bloodworth unless explicitly transferred in writing.
William Rivera-Bloodworth reserves the right to photograph and display commissioned works in portfolios, on this website, and on social media unless otherwise agreed in writing.
8. Contact form and communications
Submitting a message through the contact form does not create a contractual obligation on either party. Response times are not guaranteed. Unsolicited commercial inquiries, spam, or abusive messages may be disregarded.
Please do not submit sensitive personal or financial information through the contact form.
9. Newsletter
By subscribing to the newsletter, you agree to receive periodic emails about new work, events, and announcements. You may unsubscribe at any time using the link in any email. WCRB Design will not sell or share your email address with third parties.
Newsletter sign-up and email communications are handled through Substack. Please review their privacy practices as well.
10. AI and automated scraping prohibition
All images, artwork, text, and other content on this website are expressly excluded from use in the training, fine-tuning, or development of artificial intelligence systems, machine learning models, image generation tools, or any automated data collection process. This prohibition applies regardless of whether such use is commercial or non-commercial in nature.
The use of automated bots, scrapers, crawlers, or similar tools to collect content from this website is strictly prohibited without prior written consent from WCRB Design. Unauthorized scraping or AI ingestion of content from this site may constitute copyright infringement and will be pursued accordingly.
11. Accessibility
WCRB Design is committed to making this website accessible to all visitors, including those with disabilities. This site is built on Squarespace, which incorporates accessibility features in accordance with generally recognized web standards. If you experience any difficulty accessing content on this site, please contact william@wcrb.design and every reasonable effort will be made to assist you.
12. Disclaimer of warranties
This website and its content are provided on an "as is" basis. WCRB Design makes no warranties, expressed or implied, regarding the accuracy, completeness, or fitness for any particular purpose of the content on this site.
13. Limitation of liability
To the fullest extent permitted by law, WCRB Design shall not be liable for any indirect, incidental, or consequential damages arising from your use of this website or purchase of any works, even if advised of the possibility of such damages.
14. Governing law
These terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Monroe County, Rochester, New York.
15. Changes to these terms
These terms may be updated from time to time. Continued use of this website after changes are posted constitutes acceptance of the revised terms. The "last updated" date at the top of this page will reflect any changes.
